PARAGON Terms and Conditions

IMPORTANT: PLEASE READ CAREFULLY. THESE TERMS INCLUDE A MANDATORY ARBITRATION AGREEMENT, CLASS ACTION WAIVER, JURY TRIAL WAIVER, AND LIMITATIONS OF LIABILITY.

1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the PARAGON website and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.

2. Privacy and Cookies
Your use of the Services is subject to our Privacy Policy and Cookie Policy. These policies explain how we collect, use, share, and protect personal information and how cookies and similar technologies are used. By using the Services, you acknowledge the use of cookies, analytics tools, session replay technologies, and advertising pixels. You may manage your privacy choices through the "Your Privacy Choices" link and our Privacy Request Portal.

3. Eligibility
The Services are not directed to children under 13. By using the Services, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

4. Accounts and Security
If you create an account, you agree to provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activity under your account and must notify us immediately of unauthorized use.

7. Shipping, Returns, and Risk of Loss
Shipping timelines are estimates. Title and risk of loss transfer to you upon delivery to the carrier where permitted by law. Returns and refunds are governed by our posted return policy.

8. Intellectual Property
All content, trademarks, and materials on the Services are owned by PARAGON and may not be used without permission.

9. User Content
By submitting reviews or content, you grant PARAGON a perpetual, royalty-free license to use, reproduce, and display such content. You represent that your submissions do not violate any rights or laws.

10. Third‑Party Services
The Services may include links or integrations with third‑party services. PARAGON is not responsible for third‑party practices or content.

11. Limitation of Liability
To the fullest extent permitted by law, PARAGON shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services. PARAGON’s total liability shall not exceed the amount paid by you to PARAGON in the 12 months preceding the claim. Nothing in these Terms limits liability for personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.

12. Cybersecurity & Data Risk Allocation
While we implement reasonable safeguards, no system is completely secure. PARAGON is not liable for unauthorized access, data loss, or breaches beyond our reasonable control, including those involving third‑party service providers.

13. Assumption of Risk & Proper Use
You agree to use products and Services only as intended and acknowledge that improper use may result in damage or injury. You agree to indemnify and hold PARAGON harmless from claims arising from your misuse of the Services or violation of these Terms.

14. Force Majeure
PARAGON shall not be liable for delays or failures caused by events beyond reasonable control including natural disasters, supply chain disruptions, cyber incidents, or governmental actions.

15. Dispute Resolution & Mandatory Arbitration
Any dispute shall be resolved by binding arbitration on an individual basis. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

16. Jury Trial Waiver
To the fullest extent permitted by law, you waive any right to a jury trial.

17. Disclaimer of Warranties
The Services and products are provided "as is" and "as available" without warranties of any kind. To the extent prohibited by law, certain warranty disclaimers may not apply.

18. Governing Law & Venue
Any dispute arising from these Terms shall be governed by the laws of the State of California. Claims may be brought in the state or federal courts located in Los Angeles County, California.

19. New Jersey Residents
If you are a New Jersey resident, certain limitations may not apply to you to the extent prohibited by New Jersey law.

20. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance.

21. Entire Agreement
The Terms and the other agreements referred to herein constitute the entire agreement between you and PARAGON and supersede any prior understandings or agreements (written or oral).
