Warranty
PARAGON ONE-YEAR LIMITED WARRANTY
Effective Date: January 1, 2024
1. Warrantor
This Limited Warranty is provided by Domo Co., LLC, owner of the PARAGON trademark and manufacturer or assembler of PARAGON-branded products (“PARAGON,” “Warrantor,” “we,” “us,” or “our”).
2. Products and Geographic Scope
This Limited Warranty applies only to qualifying new PARAGON-branded products manufactured or assembled by Domo Co., LLC that are:
- Purchased directly from PARAGON or from an authorized PARAGON dealer;
- Purchased and used within the United States; and
- Used in accordance with the product’s instructions, warnings, specifications, intended purpose, and applicable installation and maintenance requirements.
International sales are not covered by this Limited Warranty. Warranty coverage does not apply to a product that is exported from, installed outside, or used outside the United States, even if the product was originally purchased or collected within the United States.
3. Who Is Covered
This Limited Warranty extends only to the original end-user purchaser of the product. It does not extend to subsequent owners and is not transferable.
A person or business purchasing a product for resale is not an end-user purchaser and receives no coverage under this Limited Warranty for that product. The ultimate end-user purchaser may qualify for coverage if the product was purchased new through an authorized PARAGON dealer and all other warranty conditions are satisfied.
Proof of purchase from PARAGON or an authorized PARAGON dealer is required.
4. Warranty Period
The Warranty Period is one (1) year from the date of the original end-user purchase.
A warranty claim must be submitted to PARAGON during the Warranty Period. Delays in inspection, evaluation, transportation, repair, or replacement do not extend or restart the original Warranty Period unless applicable law requires otherwise or PARAGON expressly agrees in writing.
5. What This Warranty Covers
During the Warranty Period, PARAGON warrants that the covered product will be free from defects in materials and workmanship under normal use, proper installation, and proper maintenance.
A “manufacturing defect” means a defect in materials or workmanship attributable to PARAGON that existed when the product left PARAGON’s control or arose during the Warranty Period under normal, intended use.
PARAGON will determine, based on its reasonable inspection and evaluation, whether the reported condition qualifies as a covered manufacturing defect. PARAGON may require photographs, video, installation records, maintenance information, operating information, diagnostic testing, return of the affected component, or return of the complete product.
6. Warranty Remedies
If PARAGON confirms a covered manufacturing defect during the Warranty Period, PARAGON will, at its option and subject to applicable law:
- Repair the covered product using new, refurbished, or serviceable replacement parts;
- Replace the covered product with the same model or a functionally equivalent product; or
- If the same model or a direct replacement is unavailable, provide another product that PARAGON reasonably determines is comparable in function.
If applicable law requires a different or additional remedy, including reimbursement under circumstances specified by law, PARAGON will provide the legally required remedy.
Repair or replacement is the exclusive remedy under this Limited Warranty to the fullest extent permitted by applicable law.
A replacement product may differ in color, finish, appearance, dimensions, features, or specifications because of product improvements, manufacturing changes, or discontinuation, provided the replacement is reasonably comparable in function.
Any product or component replaced by PARAGON becomes PARAGON’s property unless applicable law requires otherwise.
7. Covered PARAGON Labor
When PARAGON confirms a covered manufacturing defect, this Limited Warranty includes PARAGON’s reasonable in-house diagnostic and repair labor performed at PARAGON’s designated facility.
This Limited Warranty does not cover:
- On-site or field-service labor
- Third-party diagnostic or repair labor
- Product removal
- Disassembly necessary to remove the product from its installed location
- Installation or reinstallation
- Assembly or reassembly at the customer’s location
- Plumbing work
- Electrical work
- Construction or contractor work
- Wall, floor, cabinet, countertop, or building modifications
- Site preparation
- Loss of business, loss of use, or substitute equipment
- Any other incidental labor or service expense.
PARAGON will not reimburse third-party labor or service costs unless PARAGON expressly authorized the specific charge in writing before it was incurred or applicable law requires reimbursement.
8. Items Not Covered
This Limited Warranty does not cover consumable components, detachable consumables, or items subject to routine replacement or ordinary wear, including, as applicable:
- Bulbs
- Fuses
- Glass jars and other glass components
- Hoses
- Neck rests
- Rubber components
- Filters
- Accessories
- Attachments
- Other components expressly identified in the product instructions or product-specific warranty information as consumable or wear items.
The ordinary exhaustion or deterioration of a wear item is not a manufacturing defect. However, an item’s classification as a wear item does not exclude a separate defect in materials or workmanship where coverage is required by applicable law.
9. Other Warranty Exclusions
This Limited Warranty does not cover a defect, malfunction, loss, or damage caused by or resulting from:
- Normal wear and tear, aging, or routine maintenance
- Accident, misuse, abuse, neglect, improper storage, improper operation, or use for an unintended purpose
- Failure to follow operating, safety, cleaning, inspection, installation, or maintenance instructions
- Failure to perform reasonably required preventative maintenance
- Use exceeding published weight, electrical, plumbing, environmental, or operating limits
- Improper assembly, installation, plumbing, electrical work, mounting, anchoring, or site preparation
- Service, diagnosis, repair, disassembly, reassembly, modification, or alteration performed improperly by the purchaser or a third party
- Use of an incompatible attachment, accessory, replacement part, cleaning product, chemical, water treatment, electrical supply, or other non-PARAGON product
- Fire, flood, freezing, lightning, power surge, abnormal voltage, water damage, natural disaster, or other external causes
- Freight or transportation damage occurring after PARAGON properly tenders the product to the carrier
- Damage sustained while a product is being transported to PARAGON for warranty evaluation or service
- Cosmetic changes that do not impair intended function
- Staining, fading, discoloration, soiling, abrasion, scratching, peeling, or other deterioration caused by use, cleaning, chemicals, hair color, environmental exposure, or improper care
- Mineral deposits, scale, corrosion, drainage problems, water-pressure conditions, or water-quality conditions
- A removed, altered, defaced, or unreadable serial number where the serial number is reasonably necessary to verify the product or claim
- Continued use after a defect, unsafe condition, or need for repair became reasonably apparent, to the extent continued use caused or increased the claimed damage.
Third-party service or use of a third-party component does not automatically void this Limited Warranty. This warranty excludes only defects or damage caused by or related to improper third-party parts, installation, maintenance, modification, or service.
10. Products Sold Without This Warranty
This Limited Warranty does not apply to products sold as:
- Clearance
- Floor models or display models
- Refurbished
- Reconditioned
- Open-box
- Used
- Otherwise expressly identified in the sales documents as not covered by the PARAGON Limited Warranty.
Any separate written warranty expressly provided with such merchandise will govern that merchandise. Nothing in this section excludes a right that cannot lawfully be waived.
11. Licensed Installation
Plumbing, electrical, and wall-mounted products must be installed by professionals holding the licenses required for the work and location involved.
The purchaser is responsible for:
- Selecting a properly qualified and licensed professional;
- Ensuring that installation complies with product instructions and applicable codes;
- Obtaining required permits and inspections; and
- Retaining invoices, permits, photographs, and other installation records.
PARAGON may require reasonable installation documentation when installation may relate to the claimed defect.
This Limited Warranty does not cover defects or damage caused by or related to unlicensed, incomplete, incorrect, or otherwise improper installation. Failure to use a required licensed professional does not exclude coverage for a manufacturing defect that is unrelated to the installation, except where applicable law permits a broader exclusion.
12. How to Request Warranty Service
Before returning a product or component, the purchaser must contact PARAGON:
Telephone: 714-266-0061
Email: support@paragoncompanystore.com
The purchaser should provide:
- The purchaser’s name, address, telephone number, and email address;
- Proof of purchase from PARAGON or an authorized PARAGON dealer;
- The product model number;
- The serial number, where applicable;
- The purchase date;
- The name of the authorized dealer, if not purchased directly from PARAGON;
- A detailed description of the reported defect;
- Clear photographs or video showing the reported condition;
- Installation and maintenance documentation, where relevant; and
- Any additional information reasonably requested by PARAGON to evaluate the claim.
PARAGON may first conduct remote troubleshooting or request additional documentation. Remote troubleshooting does not constitute confirmation that the condition is covered.
If PARAGON determines that physical inspection is appropriate, PARAGON will issue a Return Authorization number and provide return instructions. Issuance of a Return Authorization number authorizes evaluation of the product but does not confirm warranty coverage.
Do not deliver or ship any product to PARAGON without prior authorization. Unauthorized returns may be refused or returned to the sender at the sender’s expense.
13. Return Packaging and Transportation
Unless applicable law requires otherwise, the purchaser is responsible for:
- Properly disconnecting and removing the product;
- Securely packing the product;
- Transportation to PARAGON’s designated facility;
- Insurance and tracking for the return shipment;
- Transportation back to the purchaser; and
- All related shipping, freight, packing, handling, removal, and reinstallation costs.
The purchaser must follow PARAGON’s return instructions and use packaging reasonably sufficient to protect the product during transportation. PARAGON is not responsible under this Limited Warranty for damage caused by inadequate packaging or damage occurring during transportation to PARAGON.
The purchaser must retain the shipping receipt and tracking information.
If applicable law requires PARAGON to arrange or pay transportation because the product cannot reasonably be delivered because of its size, weight, attachment, installation, or the nature of the defect, PARAGON will comply with that requirement. The purchaser must notify PARAGON before incurring any transportation, removal, or service expense.
14. Evaluation and Noncovered Conditions
PARAGON will inspect and evaluate an authorized return. If PARAGON confirms a covered manufacturing defect, PARAGON will provide the applicable warranty remedy.
If PARAGON determines that the reported condition is not covered, PARAGON will notify the purchaser. PARAGON will not perform a chargeable nonwarranty repair without the purchaser’s authorization.
Regardless of whether the condition is covered, the purchaser remains responsible for return transportation except where applicable law requires otherwise.
15. Repaired Products, Replacement Products, and Replacement Parts
A repaired product, replacement product, or replacement component is covered only for the unexpired portion of the original one-year Warranty Period.
Repair or replacement does not begin a new warranty period or extend the original Warranty Period unless applicable law requires otherwise or PARAGON expressly agrees in writing.
16. Implied Warranties
To the fullest extent permitted by applicable law, any implied warranty applicable to the product, including any implied warranty of merchantability or fitness for a particular purpose, is limited in duration to the one-year duration of this Limited Warranty.
PARAGON does not disclaim an implied warranty that cannot lawfully be disclaimed, and this provision does not shorten any minimum warranty period required by applicable law.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
17. Limitation of Damages
To the fullest extent permitted by applicable law, PARAGON will not be liable under this Limited Warranty for incidental, indirect, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, business interruption, loss of use, substitute equipment, customer claims, removal costs, installation costs, reinstallation costs, or third-party labor charges.
This limitation applies regardless of the legal theory asserted and even if PARAGON was advised that such damages were possible. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in this Limited Warranty excludes or limits liability that cannot lawfully be excluded or limited.
18. No Informal Dispute-Settlement Mechanism Required
PARAGON does not require the purchaser to use an informal dispute-settlement mechanism as a prerequisite to exercising rights under this Limited Warranty.
The purchaser should contact PARAGON promptly so that PARAGON has a reasonable opportunity to inspect the product and provide an applicable warranty remedy.
Any dispute-resolution provision contained in PARAGON’s Terms and Conditions applies only to the extent it is valid, enforceable, and consistent with applicable warranty law.
19. No Unauthorized Modification of Warranty
No PARAGON dealer, distributor, employee, representative, contractor, or other person may modify, extend, or expand this Limited Warranty unless the modification is contained in a written agreement signed by an authorized representative of Domo Co., LLC.
Statements in advertising, product descriptions, sales communications, or technical discussions do not create an additional warranty unless they expressly state that they are a warranty and are authorized by Domo Co., LLC.
Product-specific written warranty terms issued by Domo Co., LLC may supplement this Limited Warranty. If an authorized product-specific warranty expressly conflicts with this general Limited Warranty, the product-specific provision controls for that product.
20. Governing Version
The warranty terms provided with the product or made available before purchase govern the product. Later revisions apply prospectively and do not reduce warranty coverage already granted for a completed purchase.
21. Legal Rights
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Where any provision of this Limited Warranty conflicts with a nonwaivable requirement of applicable law, the legal requirement controls, and the remaining provisions continue to apply to the fullest extent permitted.
